new driving rules on the books starting today.
• Drunken drivers: Drivers under 21 caught operating a vehicle with any amount of alcohol in their system will now be treated as adults, and be assessed fines instead of a civil penalty. Fines will be $340 for the first offense, $680 for a second and $850 for a third. Previous law allowed only for an administrative action to be taken against the driver's license of a person under 21.
• Emergency vehicles: Known as the "move over, slow down" law, it requires freeway drivers who are approaching in a lane immediately adjacent to a stopped emergency vehicle with its emergency lights on, or a stopped tow truck that is displaying flashing amber warning lights, to move out of that lane when safe and possible or slow to a reasonable and safe speed.
• Riding in the trunk: This prohibits the driver from allowing a person to ride in the trunk. It also prohibits any person from riding in the trunk. The fine is $100 for the first violation, $200 for a second and $250 for a third.
• Reckless driving and speed contests: Penalties for a person convicted of reckless driving or a speed contest have been increased when the driver causes serious injuries.
• Smog check: Any smoke from a tailpipe or crankcase during an inspection will result in failing the smog test.
• Hybrids: Hybrid cars with clean air stickers can now be driven in carpool lanes on Santa Clara County expressways. This week, the state will begin mailing out the final 10,000 sets of carpool stickers to hybrid owners.
• Bridge tolls: Rise to $4 on state-owned bridges in the Bay Area.
