**edited for added dmv quotes
so you gotta get it to pass, then you got your 90 day window to sell
"The seller is required to provide the buyer with a valid smog inspection certification at the time of the sale or transfer. Smog certifications are good for 90 days from the date of issuance."
" NOTE: Smog certifications are not required for transfers that occur for a gasoline powered motor vehicle that is four or less model years old. (Determine the oldest-qualifying year model by subtracting three from the current year) the four or less model years old rule does not apply to diesel powered vehicles. A smog transfer fee will be collected from the new owner. "

If that's the case, then I'll write up a contract which will state that the buyer is responsible for smog and I will provide all the necessary parts to make the Evo smoggable.

Updated with better recent pictures
Evo passed smog on 10/15/11. Have papers for proof.
1) Evo got an alignment on 10/18/11.
2) Evo is now on 5zigen FN01R-C with Nitto NT05 tires that has 1000 miles on them. If buyer wants to have the BBS SE rims included in the sale, we can work out a deal.
I'll be updating the pictures to show the Evo with the current wheels setup.
